[논문 초록]

이 연구는 유학생의 불법노동을 줄이려는 일련의 정책적 시도에도 불구하고 미허가 노동이 만연한 현실을 이해하기 위해 유학생의 불법노동이 생산되어 지속되는 과정을 분석하는 것을 목적으로 한다. 이를 위해 법인류학에서 발전시킨 ‘불법성’의 개념을 가져와 불법노동을 문제(problem)로 바라보기보다는 역사적, 정치·사회·경제적으로 생산된 것으로 보고 한국 정부와 대학-유학원의 이해관계, 그리고 유학생의 사회적 환경이 맞물리면서 불법노동이 생산된다는 점을 밝힌다. 또한 지방대학에 재학 중인 몽골과 베트남 출신 유학생에 대한 면담을 통해 실제 유학생들이 미허가 상태에서 노동을 행하는 경험을 자세히 살펴 이들의 노동이 ‘불법’의 영역으로 분류되는 것이 이들의 한국살이에 미치는 영향을 구체적으로 파악한다. 이를 통해 이 연구는 유학생의 미허가 노동을 유학 비자를 악용하려는 의도를 가진 이주자의 일탈적 행위로 바라보는 한국 정부와 언론의 시각을 정면으로 반박하고, 불법의 영역에 놓인 유학생 이주자들이 노동자로서 제대로 된 권리를 행사할 수 없는 상황에 처해 있다는 점을 지적한다.

This study explores how “illegal” labor has been popularized among international students in Korean universities although the Korean government has strongly promoted series of policies to crack down such “illegal” labor. Drawing on the concept of “illegality” that legal anthropologists developed, this research reveals “illegality” does not denote “problem,” but is produced by the interactions of interested parties including the government, universities, migration agencies, and international students. Furthermore, based on interviews with Mongolian and Vietnamese students in Korean regional universities, this study highlights how “illegality” of their labor shapes their lives in Korea. By spotlighting the processes of how “illegal” labor has been produced by diverse social actors, this study ultimately refutes the approach of the Korean government and media that identifies the “illegal” labor of international students as the outcome of their deliberate behaviors to break the law
